NSW: Health Legislation Amendment Bill 2009 [New Bill]

This Bill proposes to amend various principal Acts in the health portfolio which include:

(NSW) Drug and Alcohol Treatment Act 2007 regarding the removal of the need of a medical practitioner to be satisfied of a patient to be medically fit when granting leave of absence from a treatment centre,

(NSW) Health Administration Act 1982 in relation of appointment of the Medical Services Committee for 3 terms of office, with each term of office being 4 years,

(NSW) Health Care Complaints Act 1993 to provide the Health Care Complaints Commission certain discretionary power in investigation, prosecution, delegation of duties, and disclosure of obtained information,

(NSW) Health Services Act 1997 regarding appointment in a health corporation’s board and extends the personal liability provision,

(NSW) Medical Practice Act 1992 to allow legal representation in a Professional Standards Committee inquiry,

(NSW) Mental Health Act 2007 which removes the need to provide 14 days’ notice for an application for a further community treatment order and  appointment of  the President of the Mental Health Review Tribunal as a full-time or part-time member.
