Allens Arthur Robinson is acting for the Victorian Government's Department of Transport on its worldwide tender for the operation of Melbourne's train and tram networks, known as the Metropolitan Rail (Train and Tram) Franchising Project.

The Victorian Government has announced that the MTM and KDR consortia have been chosen as the preferred tenderers to operate Melbourne's train and tram networks, respectively.

Allens has acted as legal adviser to the Department of Transport since the beginning of the project. This included advising on the tender documents and undertaking an extensive review and redrafting of the existing franchise agreements, infrastructure leases, rolling stock supply, maintenance and leasing agreements, inter-operator agreements and third-party contracts.

The Allens team has been led by partner Paul Kenny, and includes partners David McLeish and Ted Hill.

Kenny said the project showcases the Allens teams' ability to provide legal services of a major transactional nature and the firm's in-depth understanding of the privatised Victorian rail sector.

"Allens' involvement since 1996 in rail sector reform has enabled it to advise on all aspects of the transaction and its interaction with the existing contractual, legislative and regulatory regime," Kenny said.

"The firm has also demonstrated its experience in working productively in multi-disciplinary teams with other advisers to the Victorian Government."
