BARRISTERS AND solicitors were permitted to take and receive affidavits and statutory declarations under amendments to the Oaths Act 1900, which commenced at the beginning of this year. But the NSW Bar Association recently warned barristers that, although this was a welcome change to the law, they should be aware that it would be considered inappropriate for them to witness an affidavit for use in proceedings in which they were briefed to appear.
