Celebrity chef George Calombaris is embroiled in a legal battle with Mr Whippy, the mobile icecream truck, over a dessert in the chef’s St Katherine’s Melbourne restaurant.

Franchised Food Company (FFC), which owns the Mr Whippy brand, has accused the Masterchef judge of trademark infringement with a dessert.

“We plan to enforce our rights,” FFC owner Stan Gordon told The Daily Telegraph.

Gordon allegedly sent Calombaris a letter raising its concerns over the dessert, which was originally called “Mr Whippy”. The restaurant changed the name to “Mrs Whippi”, and sent a response to Gordon arguing that the original Mr Whippy product has no reputation in the restaurant scene.

Gordon is seeking damages in the Federal Magistrate’s Court, claiming Mr Whippy is a victim of a trademark infringement.

Gordon said is sick of his product being “ripped off”, The Telegraph reports.

Calombaris showed he is apparently not concerned about the claims on Twitter today, tweeting: “Next time you’re at @StKatsKew try our soft serve ice cream, you’ll enjoy it” and “My solicitor said that I look good in a wig and gown which is good as I am always prepared to fight for my integrity.”
