Herbert Smith Freehills elevates 7 to counsel in annual promotions round

Herbert Smith Freehills has promoted seven lawyers to executive counsel or special counsel roles in Australia.

These appointments form part of Herbert Smith Freehills’ annual counsel promotions, which sees the firm raising 29 to counsel positions across its global network. The appointments take effect from 1 May 2020.

In the construction and infrastructure dispute resolution, newly appointed executive counsel Carla Aumann is an experienced litigator specialising in the resolution of disputes in the construction, energy and infrastructure sectors. 

She has more than 13 years’ experience resolving complex construction law claims, including on some of Australia’s largest projects, and is highly skilled in claims management and dispute avoidance strategies.

Joining too is executive counsel Timana Hattam, a specialist in the resolution of disputes in construction and infrastructure projects, and has significant experience advising in relation to PPPs. Ms Hattam has advised clients on renewables projects across Australia and internationally, as well as oil and gas initiatives.

In HSF’s M&A/private equity practice Francine Kinkade is appointed to executive counsel.

She advises private equity, corporate, and government clients on acquisitions, carve-outs, divestments, investments and joint ventures across a range of sectors, including industrials, healthcare, consumer goods and technology. 

Ms Kinkade has advised on numerous complex domestic and cross-border transactions in Australia and the UK, as well as advised clients on commercial contracts and corporate compliance matters.

Julia Massarin is appointed special counsel in HSF’s financial services regulatory practice in Melbourne. 

Ms Massarin is an expert in banking and financial services regulation. She specialises in anti-money laundering and counterterrorism financing law, consumer credit and retail banking law, payment systems regulation, financial services licensing, Australian Consumer Law and personal property securities legislation. 

Ms Massari has an excellent understanding of the commercial drivers and challenges faced by financial service providers after completing secondments in the legal teams of major ADIs.

In HSF’s employment, industrial relations and safety practice, Wendy Fauvel, joins the firm’s Brisbane office as executive counsel. 

Ms Fauvel is an expert in the field of enterprise bargaining and industrial disputes, and has a broad practice in all areas of employment law. 

She provides advice on enterprise bargaining strategy, the interpretation of industrial instruments, the drafting and implementation of enterprise agreements, dispute resolution, and responses to industrial action for both public and private sector clients.

Nerida Jessup, appointed to special counsel in workplace health and safety practice in Sydney, is a safety lawyer who is experienced in providing advice on the management of serious safety incidents. 

She regularly acts on safety prosecutions and coronial inquests, and advises employers and boards about safety governance issues. 

Ms Jessup advises public and private sector clients on work health and safety issues in a range of industries including rail, mining, construction, energy, manufacturing and financial services.

Finally, Julie Marotta will be appointed to HSF’s workplace health and safety in Melbourne as special counsel. 

Ms Marotta specialises in work health and safety law, providing advice and training to clients across all general and industry-specific safety law. 

She regularly assists clients in the aftermath of workplace incidents, providing on the ground legal support including advising on issues relating to union right of entry and internal investigations. 

Ms Marotta also has extensive experience representing clients in relation to WHS investigative and enforcement action taken by unions or safety regulators.
