La Trobe deputy dean named as external legal adviser for Commonwealth standing committee for the scrutiny of delegated legislation

Professor Lorne Neudorf, who is the deputy dean of La Trobe Law School, has been appointed external legal adviser to the Commonwealth Senate standing committee for the scrutiny of delegated legislation.

The Commonwealth Senate standing committee — formerly known as the Senate standing committee on regulations and ordinances — was established in 1932 and serves as a model for numerous similar scrutiny committees across Australia and abroad.

It plays a critical role in maintaining parliamentary oversight of the lawmaking process, La Trobe noted in a statement to Lawyers Weekly, and annually scrutinises approximately 1,500 new disallowable delegated instruments tabled in Parliament, with a focus on ensuring statutory compliance, protecting individual rights and liberties, and adhering to the principles of parliamentary oversight.

Speaking about his new role, Professor Neudorf said: “My appointment as the external legal adviser is a tremendous honour and important recognition of my research on delegated legislation.”

“I very much look forward to assisting the committee in carrying out its work, which is essential to upholding the rule of law and the proper functioning of our parliamentary democracy.”

Historically, the role of external legal adviser was held by a senior barrister, La Trobe noted; however, since the mid-1980s, the committee has transitioned to appointing distinguished academics specialising in delegated legislation or other relevant legal areas.

In his new role, Professor Neudorf is set to provide the committee with an independent legal assessment of delegated legislation, evaluating compliance with the committee’s scrutiny principles and otherwise assisting the committee with its work.
