Victorian Bar launches new cost-saving arbitration scheme 

Commercial and civil disputes can now be resolved out of court with the Victorian Bar’s new arbitration scheme, aimed at timely and cost-effective resolutions.

The Victorian Bar has launched the Victorian Arbitration Scheme (VCAS) to assist the parties that prefer to have their dispute resolved by a private arbitrator rather than with a judge and receive a binding judgement that can be enforced in much the same way. 

The VCAS was developed to provide time-efficient and low-cost resolution of disputes by imposing a fixed-time frame. It will be overseen by the Honourable Clyde Croft AM SC, the former judge in charge of the arbitration list in the commercial court. 

Judge Croft said he believes VCAS will be of particular benefit to commercial disputes in regional Victoria, providing a “fast, low-cost solution” in local or online venues. 

 
 

“VCAS is of particular utility at a time when courts and tribunals are accumulating the backlog of cases due to COVID-19 and travel throughout the state is restricted,” Judge Croft said.  

President Wendy Harris QC said VCAS is one of the many initiatives developed by the Victorian Bar that assists residents in resolving disputes effectively and conclusively. 

“VCAS’s flexibility, speed and affordability will appeal to parties who would otherwise be put off by the high costs, delays and uncertainty commonly associated with a court litigation. My particular thanks to Robert Heath QC, Adam Rollnik and Kieran Hickie for designing and spearheading this initiative,” Ms Harris said in a statement. 

VCAS is the second innovative solution designed by the bar to assist parties to resolve disputes fast, particularly during COVID-19. The first was its Expedited Mediation Scheme which provided courts with resources to refer appropriate matters to the bar’s nationally accredited mediators for resolution.
