Australia is on track to having its first dual Federal-State judge, following an agreement reached between Federal Attorney-General Robert McClelland and Victorian Attorney-General Rob Hulls.

 
 

The intention of the arrangement is to allow both the Commonwealth and Victoria to jointly utilise the experience and expertise of judges across jurisdictions.

First in line for dual appointment will be recent Federal Court appointee Justice Julie Dodds-Streeton. In order to enable this arrangement to take place, the Victorian Government will move to amend legislation to also allow for the her reappointment to the Victorian Supreme Court where she sat on the Court of Appeal before her Federal Court appointment.

Following the announcement of the Victorian agreement, NSW Attorney-General John Hatzistergos also indicated his intention to similarly amend NSW legislation to allow for dual appointments. McClelland said he will seek similar amendments across all Australian jurisdictions.
