In-house lawyer lectures on competition

An upcoming Australian Corporate Lawyers Association seminar aimed at providing in-house lawyers with the skills to spot competition law issues in transactions and in dealings with competitors will be held at Freehills' Melbourne office from this week.

An Australian Corporate Lawyers Association master class, aimed at providing in-house lawyers with the skill to spot competition law issues in transactions and in dealings with competitors, will be held at Freehills' Melbourne office from this week. 


Competition law academic Caron Beaton-Wells will be presenting the seminar, giving in-house lawyers a rundown in the essentials of competition law. Attendees will be shown the relevant parts of the Trade Practices Act, and will cover the underlying economic policy and concepts, as well as the substantive prohibitions on anti-competative conduct. 


The seminar will include in-depth discussion of recent and proposed amendments in important substantive areas including cartels, misuse of market power and merger review, as well as in relation to the policies and investigatory powers of the Australian Competition and Consumer Commission. 


As part of the course, which runs until Wednesday 13 May in half-day seminars, in-house lawyers will be shown how to brief external lawyers in a timely fashion. 


It will also canvas approaches to compliance, with a view to ensuring such issues do not arise, and enforcement, should enforcement action be threatened or taken. In conjunction with Freehills, practical aspects of advising on competition law issues will be canvassed from a practitioner perspective. 

 

Lawyers from Freehills will play an active part in the seminars, including in discussion of a merger case-study and in a 

role play regarding a cartel immunity application.
