Deal: Global law firm Ashurst has advised Transport for NSW on the procurement of the Sydney Roads Asset Performance contracts (SRAP contracts) for the maintenance of roads and intelligent transport systems across greater Sydney.

Key players: The Ashurst team was led by Gareth Sage, assisted by counsel Ben Kipic, lawyers Tom Darling and India Coultas.

Deal significance: The SRAP contracts ensure that each service provider manages and maintains assets so they are safe, efficient, sustainable and reliable for all road users. Ashurst has advised Transport for NSW in relation to all aspects of the procurement process for the project. 

“We are pleased to have worked alongside Transport for NSW as it continues to develop innovative contracting approaches to improve outcomes for road users across greater Sydney,” Mr Sage said.

The SRAP contracts were executed on 17 December 2020 with the following parties:

  • Harbour Zone - ConnectSydney (Lendlease, Boral, and Tyco)
  • River Zone - Fulton Hogan
  • Parkland Zone - LinkingSydney (Ventia)
In 2013, Ashurst advised Roads and Maritime Service (RMS) on the performance-based road maintenance contracts for the Sydney Metropolitan area known as the Stewardship Maintenance Contracts (SMCs).

The SRAP contracts have continued to develop the stewardship principles introduced under the SMCs. This model focuses on contractor performance measures, data-driven decision-making, transferring risk to the contractor and encouraging innovation to enhance the customer experience, sustainability and safety.
