Jacqueline Henderson has fought for the right to use affidavits prepared by her former co-host, Kyle Sandilands, and his longtime manager in her wrongful termination proceedings.
The Federal Court has weighed in on whether affidavits filed by Kyle Sandilands and his manager, Bruno Bouchet, can be used by Jacqueline Henderson in her termination fight with ARN Media.
It comes about a week after ARN Media announced via ASX that it has settled unfair termination proceedings with Sandilands for $12.09 million and an agreement to advertise his new, independent media project on its platforms for the next three years.
Lawyers for Sandilands argued against their release on the grounds that they were the subject of an obligation to the court not to use them for purposes other than his now-abandoned dismissal proceedings.
However, Justice Angus Stewart said the affidavits were filed on or around the same day the deed of release was executed.
“They truly did file the affidavits voluntarily, as they need not file them at all once the proceedings were compromised,” he said.
He added that the “relevant point” was that the information in the affidavits were not disclosed “under any form of compulsion”.
While lawyers for Sandilands alleged the information within them would be inadmissible, Justice Stewart said it was not clear why.
Justice Stewart did not make an order for costs but made it clear this could potentially be a matter for taxation and assessment if a costs dispute arises in Henderson’s proceedings.
Henderson has claimed at least $82 million in compensation for her alleged unlawful termination.
Their show came to an abrupt end after Sandilands accused Henderson of “being off with the fairies” on-air.
Henderson alleged Sandilands made degrading comments about her character and dating life on 20 August 2025, including “your real is not everyone’s real” and he was worried she would “never find anyone because … all these requirements that you have”.
Sandilands also allegedly referred to her “period time”, claimed she had kept “saying the same b------t that no one understands”, and made a comment about “all these books but no idea” in relation to statements Henderson had made on the subject of anxiety.
