Fogarty has been a solicitor in the community legal sector since 2004, specialising in disability rights and discrimination law.

In 2007 he spent six months in the Northern Territory as the outreach solicitor for Darwin Community Legal Service and in 2010 became the acting director of pro bono at Gilbert + Tobin.

He has also worked as a solicitor at the Redfern Legal Centre, Inner City Legal Centre and Marrickville Community Legal Centre.

In addition to his work as a solicitor, Fogarty has lectured in criminal law at the University of NSW since 2005.
